Terms of Use & Service Agreement

These Terms govern both your use of fp-plumbing.ca and the provision of plumbing services by FP Plumbing to customers in Ontario, Canada. Please read them carefully.

1. Acceptance of Terms

By accessing fp-plumbing.ca(the “Site”), submitting a service request, booking an appointment, or engaging FP Plumbing to perform any work, you agree to be bound by these Terms of Use & Service Agreement (“Terms”). If you do not agree, please do not use the Site or engage our services.

These Terms constitute a legally binding agreement under the laws of the Province of Ontario. They apply to homeowners, tenants, property managers, and any other person who engages FP Plumbing in a residential or light-commercial capacity.

2. About FP Plumbing

FP Plumbing is a licensed residential plumbing contractor operating in the Greater Toronto Area, Ontario, Canada. Our owner holds a valid Ontario Certificate of Qualification as a plumber issued under the Skilled Trades and Apprenticeship Act, 2021. We carry general liability insurance and WSIB (Workplace Safety and Insurance Board) coverage.

Proof of licensing and insurance is available upon request before or during any service call.

3. Scope of Services

FP Plumbing provides residential and light-commercial plumbing services including, but not limited to: drain cleaning, pipe repair and replacement, fixture installation, water heater service, sump pump service, and 24/7 emergency plumbing response across the Greater Toronto Area.

All work is performed in accordance with the Ontario Building Code (OBC), applicable municipal plumbing by-laws, and the standards of the trade. We reserve the right to decline any work that cannot be performed safely, legally, or competently.

4. Quotes, Estimates, and Pricing

Quotes via phone or text. Estimates provided by phone or text message are preliminary and based on the information you supply. They are not binding quotes. A binding quote is provided in writing after our plumber has inspected the work site in person.

Written quotes. Where we provide a written quote following an on-site assessment, that quote is valid for 14 calendar days from the date of issue, unless otherwise stated on the quote. Quotes may be revised if the scope of work changes, hidden conditions are discovered, or materials costs change materially.

Diagnostic / service-call fees. Where applicable, a diagnostic or service-call fee may be charged to attend your property and assess the problem. This fee will be disclosed to you before we schedule the visit. It is credited against the cost of work if you proceed.

Emergency and after-hours rates. Work performed outside of regular business hours (evenings, weekends, and statutory holidays) may be subject to a premium rate. Emergency surcharges will be disclosed to you before work commences.

Changes in scope. If additional work is required beyond the original agreed scope (for example, a concealed defect is discovered once work begins), we will contact you before proceeding and provide a revised quote. We will not perform work beyond the agreed scope without your authorization.

5. Appointments and Scheduling

Appointment windows are provided as a courtesy estimate. While we make every reasonable effort to arrive within the stated window, delays can occur due to emergency calls, traffic, or prior jobs running long. We will contact you if we are running significantly late.

Your responsibilities. You (or an authorized adult, 18+) must be present at the property during the service appointment. The work area must be reasonably accessible and safe for our plumber to work. You are responsible for clearing access to shut-off valves, the water meter, and any plumbing fixture being serviced before our arrival. Failure to provide access may result in a no-access fee and rescheduling.

6. Cancellation and No-Show Policy

Cancelling an appointment. We request at least 24 hours’ noticeif you need to cancel or reschedule a non-emergency appointment. Cancellations with less than 24 hours’ notice may be subject to a cancellation fee to cover our plumber’s mobilization costs. Any applicable fee will be communicated to you at the time of booking.

No-access / no-show. If our plumber attends your property and is unable to gain access, or if no authorized adult is present, a no-access fee equal to the service-call charge may apply.

Emergency calls. Given the time-sensitive nature of emergency plumbing, no-shows or last-minute cancellations of emergency calls may result in a fee to cover mobilization costs.

7. Payment Terms

Payment is due upon completion of work unless otherwise agreed in writing. We accept cash, e-Transfer, major credit cards, and debit. Accepted payment methods will be confirmed at the time of booking.

Invoices. An itemized invoice will be provided for all work completed. HST (Harmonized Sales Tax) will be applied to all taxable goods and services in accordance with the Excise Tax Act.

Overdue balances. Invoices not paid within 30 days of the due date may be subject to interest at a rate of 1.5% per month (18% per annum) compounded monthly, or the maximum rate permitted by Ontario law, whichever is less.

Deposits. For larger projects (typically those exceeding $1,000 in estimated cost), we may require a deposit of up to 30% before work commences. Deposits will be applied against the final invoice. Deposit terms will be stated in the written quote.

Disputed invoices. If you dispute any portion of an invoice, please notify us in writing within 7 days of receipt. We will work with you in good faith to resolve any discrepancy. Undisputed portions of an invoice remain payable on the original due date.

8. Workmanship Warranty

FP Plumbing warrants that all labour performed by us will be free from defects in workmanship for a period of 1 year from the date of completion, subject to the exclusions below.

Parts and materials supplied by us are subject to the manufacturer’s warranty, which we will assist you in claiming where applicable. We do not provide an additional warranty on customer-supplied parts.

Warranty exclusions. Our workmanship warranty does not cover:

  • Damage caused by misuse, abuse, neglect, or unauthorized modification of our work by a third party
  • Pre-existing conditions in your plumbing system not caused by our work
  • Normal wear and tear, including deterioration of older pipes or fixtures unrelated to the repair
  • Issues arising from customer-supplied parts or materials
  • Consequential or indirect damage (e.g., water damage caused by a failure in a part of the system we did not service)

To make a warranty claim, contact us by phone or text within the warranty period. We will schedule a return visit within a reasonable time at no additional charge if the defect falls within the scope of the warranty.

9. Permits and Regulatory Compliance

Certain plumbing work in Ontario requires a building permit issued by your local municipality under the Building Code Act, 1992 and the Ontario Building Code. Examples of work that typically requires a permit include: new plumbing rough-ins, relocation of existing drainage or supply lines, and the installation of backwater valves.

Where a permit is required, we will advise you of this before work commences. The responsibility for obtaining the permit rests with the property owner, though we can assist you in the application process. Work will not proceed where a required permit has not been obtained, unless your municipality has confirmed that the work is exempt.

Permit fees, inspection fees, and any associated costs are the responsibility of the property owner and are not included in our quoted price unless explicitly stated.

10. Ontario Consumer Protection Act

Our services to residential consumers in Ontario are subject to the Consumer Protection Act, 2002 (Ontario). Among your rights under that Act:

  • Right to a written agreement. For consumer agreements for services with a total cost exceeding $50, you are entitled to receive a written agreement that includes a fair and accurate description of the services, the total price, and payment terms.
  • Cooling-off period. For direct agreements (agreements entered into at your home, rather than our business premises), you have the right to cancel the agreement within 10 days of receiving a written copy of the agreement, without penalty and without giving a reason.
  • Right to cancel for non-delivery. If we fail to begin or complete the services within 30 days of the agreed start date (unless we notify you of a delay and you agree to extend), you may have the right to cancel the agreement.

Nothing in these Terms limits or waives any right you have under the Consumer Protection Act, 2002 or any other applicable consumer protection legislation.

11. Limitation of Liability

Website. The information onfp-plumbing.ca is provided for general informational purposes only. FP Plumbing makes no representations or warranties about the accuracy, completeness, or suitability of any information on the Site. Pricing, availability, and service details are subject to change without notice.

Services.To the maximum extent permitted by applicable law, FP Plumbing’s liability for any claim arising from or related to the services we provide is limited to the amount actually paid by you for the specific work that gave rise to the claim.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of profits, or damages to property not directly caused by our negligence.

Nothing in this section excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under Ontario law.

12. Your Property and Our Liability

We will take reasonable care of your property while performing work. However, incidental access damage that is unavoidable during the proper performance of plumbing work (e.g., cutting a small opening in drywall to access a pipe) is not covered by our warranty and will be disclosed to you before the access is made, where practical.

You are responsible for disclosing any known hazards at the property (e.g., asbestos, known lead pipes, pest infestations, structural instability) before our plumber begins work. Failure to disclose may affect the scope of our liability.

We carry general liability insurance. A certificate of insurance is available upon request.

13. Right to Refuse Service

FP Plumbing reserves the right to refuse or discontinue service at any time if:

  • The work site is unsafe or poses an unreasonable hazard to our plumber
  • Performing the requested work would violate the Ontario Building Code, applicable by-laws, or our professional obligations
  • The work requested falls outside our scope of licensure or competence
  • We have reasonable grounds to believe we have been given false or misleading information about the nature of the work

Where we discontinue service mid-job due to a safety concern not attributable to you, we will charge only for work completed up to that point.

14. Intellectual Property

All content on fp-plumbing.ca — including text, photographs, graphics, logos, and design — is the property of FP Plumbing and is protected by applicable Canadian copyright law. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.

Nothing on this Site grants you any licence to use our trade name, trademarks, or logos.

15. Third-Party Links

Our Site may contain links to third-party websites (e.g., HomeStars, Google Reviews). These links are provided for convenience only. We do not control those websites, do not endorse their content, and are not responsible for their privacy practices or accuracy. Your use of third-party websites is at your own risk.

16. Prohibited Uses

You agree not to use this Site to:

  • Submit false, fraudulent, or misleading service requests
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems
  • Introduce viruses, malware, or any other harmful code
  • Scrape, harvest, or collect personal information from the Site
  • Violate any applicable federal, provincial, or municipal law or regulation

17. Force Majeure

FP Plumbing is not liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including severe weather events, natural disasters, supply chain disruptions, labour disputes, or acts of a government authority. We will notify you promptly of any such delay and will reschedule service as soon as reasonably practicable.

18. Dispute Resolution

We are committed to resolving any concerns fairly and efficiently. If you have a dispute with us, please contact us first by phone or text at (647) 643-0358. We will make a genuine effort to resolve the issue within 14 days.

If we are unable to resolve the dispute informally, either party may refer the matter to mediation or to the Ontario Small Claims Court (for claims up to $35,000) or the Superior Court of Justice, as appropriate.

You may also contact the Skilled Trades Ontario to make a complaint about a licensed tradesperson.

19. Governing Law

These Terms are governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any dispute arising under or related to these Terms.

20. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when changes were most recently made. Continued use of the Site or our services after the updated Terms are posted constitutes your acceptance of the revised Terms.

21. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with any written service agreement or quote provided to you, constitute the entire agreement between you and FP Plumbing with respect to the subject matter hereof, and supersede all prior or contemporaneous representations, understandings, and agreements.
